Terms and Conditions of Use for Shigiikoma Skyline

Effectiveness of the Terms and Conditions

[Article 1]

Contracts regarding the use of the following general motorway operated by the Company (hereinafter referred to as the “motorway”) shall be governed by these Terms and Conditions, unless otherwise agreed. However, any matters not stipulated in these Terms and Conditions shall be governed by the provisions of laws and regulations or general customs.

  1. Starting point: 5-7, Tatsuma, Daito-shi, Osaka
    End point: 1110-8 Shigisan-nishi, Sango-cho, Ikoma-gun, Nara

  2. Starting point: 2116-110 Tawaraguchi-cho, Ikoma-shi, Nara
    End point: 2314 Nabata-cho, Ikoma-shi, Nara

  3. Starting point: 500-5 Kyokoji, Yao-shi, Osaka
    End point: 358-1 Oaza Minamihata, Sango-cho, Ikoma-gun, Nara

Use period, etc.

[Article 2]

  1. The period during which the motorway can be used shall be from January 1 to December 31, and the hours during which vehicles can be used (hereinafter referred to as the “hours of use”) shall be from 6:30 a.m. to 11:00 p.m. However, the Hozan-ji Line and a section of the Sanjo Line (Ikoma Tozanguchi - Ikoma Shoten) are open all night on the last day of every month, and all lines are open all night on December 31.

  2. The hours of use in the preceding paragraph may be changed.

  3. The motorway can be closed outside the hours of use in paragraph 1.

Tolls

[Article 3]

The tolls for the motorway shall be those approved by the Minister of Land, Infrastructure, Transport and Tourism on the day of use.

Tickets

[Article 4]

The types of tickets shall be as follows.

  1. Normal ticket

  2. Toll-paid ticket

Toll receipt, etc.

[Article 5]

  1. A driver and passengers of vehicles using the motorway (hereinafter referred to as the “users”) must pay the toll for the section of the motorway that they have used by taking a normal ticket from the automatic ticket dispenser at the tollgate when entering the motorway and inserting the normal ticket into the automatic toll payment machine when exiting the motorway. However, this does not apply to the case in which the users have paid the toll in advance through the prescribed procedure and have a toll-paid ticket.

  2. The users who have the toll-paid ticket, if there is a difference between the toll paid and the toll for the section that they used, must pay the difference.

  3. If the users are asked to exit the motorway for violating the provisions of Article 9 or Article 13 or for falling under Article 10, Items 1 to 4, the users must pay the toll for the section of the motorway that they used.

Possession of a ticket, etc.

[Article 6]

  1. The users must possess the ticket from when they pass through the tollgate in paragraph 1 of the previous article until when they finish use of the motorway, and they must present it when requested by a staff member of the Company.

  2. If the users lose the ticket, the toll for the longest section will be charged, unless the section of the motorway that they used is clear.

Unauthorized use of the motorway

[Article 7]

If any users have used the motorway illegally, the Company can collect an amount equivalent to double the regular toll in addition to the regular toll from them.

Refund of the toll, etc.

[Article 8]

The Company will not refund the tolls that have already been paid.

Instructions from staff

[Article 9]

The users must observe the instructions given by staff of the Company in the course of their duties to maintain the safety of the motorway or to control traffic.

Refusal of use

[Article 10]

  1. The Company will refuse to allow the motorway to be used in the following cases:

    1. When the use of the motorway violates laws or regulations restricting its use for safety reasons

    2. When the users use the vehicle outside of the hours of use, or when it is deemed to be extremely difficult for the users to finish using the vehicle within the hours of use

    3. When the use of the motorway is likely to cause significant interference with the passage of other vehicles

    4. When the use of the vehicle is against public order or public morals

    5. When the motorway is temporarily closed for use as a venue for special events organized by the national government, local governments, or organizations equivalent to these, or by organizations that the Company deems to contribute to regional development

    6. When there is a hindrance to the passage of vehicles due to natural disasters or other unavoidable reasons

  2. If the users violate the provisions of the preceding article or Article 13, if the use of the vehicle falls under any of the items 1 to 5 of the preceding paragraph, or if the situation described in item 6 occurs, the Company can request the users to leave the motorway.

  3. If the situation described in item 6 of this Article occurs and the Company requests the users who are using the motorway to leave the motorway for safety reasons, the Company will not collect the toll and will promptly have the users leave the motorway from the nearest tollgate.

Responsibility of the Company

[Article 11]

  1. If the Company causes damage to the life, body, or property of the users as a result of the use of the motorway due to a defect in the management of the motorway, the Company will compensate for the damage, except in the case of any of the following items.

    1. Intentional or negligent acts of the users

    2. Accidents caused by contact or collision between vehicles or falling objects, etc., for which the Company is not responsible

    3. Theft or other damage caused by a third party

    4. Acts of God or other force majeure

  2. In the case of the preceding paragraph, the Company's responsibility begins when the users enter the motorway and ends when the users exit the motorway.

Responsibility of the users

[Article 12]

Users who have damaged the motorway or its attached facilities intentionally or through negligence must restore them to their original state or compensate for the damage.

Prohibition of the sale of goods, etc.

[Article 13]

The users must not sell, distribute or advertise goods or engage in any other similar activities on the motorway without the express permission of the Company.

The following vehicles are prohibited from using the motorway for safety reasons.

  • Vehicles (including freight) over 12 m in length

  • Vehicles over 2.5 m in width

  • Vehicles (including freight) over 3.8 m in height

  • Vehicles (including freight) over 20 t in weight

  • Vehicles with caterpillars and other vehicles with structures or equipment that may damage the motorway

Pedestrians, bicycles, etc. are prohibited from using the motorway.
